Bennett Falk joined the firm as a Principal in the Florida office of the Securities Litigation and Regulation practice group in 2004.  He has been actively involved in securities litigation and arbitration for over three decades.  Bennett brings extensive experience in representing financial institutions and broker-dealers in all aspects of securities law, including the defense of class actions in both federal and state court, as well as the defense of firms and individuals in arbitration proceedings. During his career, Bennett has handled thousands of cases and has arbitrated or tried to conclusion hundreds of these cases.  He is also experienced in regulatory proceedings before the Securities and Exchange Commission, New York Stock Exchange and the Financial Industry Regulatory Authority.

Bennett has served as an arbitrator and panel chair at the New York Stock Exchange, American Stock Exchange, Financial Industry Regulatory Authority and the National Futures Association.  Bennett is a regular contributing author to the ABA Securities Litigation Committee’s Broker-Dealer Litigation Annual Survey.  He has been a featured speaker on broker-dealer regulation and securities litigation at seminars sponsored by the Securities Industry and Financial Markets Association’s Law and Compliance Division, the Florida Securities Dealers Association, the American Law Institute — American Bar Association and the Futures Industry Association.

Bennett’s most recent published decision, South Cherry Street, LLC v. Hennessee Group, LLC, et al, 2009 WL 2032133(2d Cir. 2009), involved the successful defense of federal securities law and common law claims brought against an independent investment advisor for recommending an investment in the Bayou Funds, a similar factual situation to the Madoff litigation.
