Trusts & Estates

Giving you peace of mind. Relieving you of the stresses associated with family problems. Helping you plan for your family’s future. These are the hallmarks of the Bressler, Amery & Ross trusts and estates practice. Our trusts and estates attorneys aim to solve your problems by applying technical expertise in tax law and varied experience in dealing with a multitude of family situations.

Our trusts and estates expertise is based on strong professional backgrounds. Two of our members are fellows of the American College of Trust and Estate Counsel and one is a past Chair of the New Jersey State Bar Association’s Real Property, Probate and Trust Law. We have also played an integral role in drafting and implementing a number of laws pertaining to trusts and estates.

Our trusts and estates attorneys have expertise in the following areas:

Estate planning

Our attorneys strive to assist the transfer of wealth to the younger generation using vehicles that afford the maximum degree of control at minimal cost. Using both complex and simple planning techniques, our estate planning services include preparing wills, revocable and irrevocable trusts, special needs trusts, family limited partnerships, limited liability companies and charitable trusts. Working with accountants, investment advisors, trust officers, insurance professionals, and your other professional advisors, we can help you formulate a lifetime gifting plan, engage in asset protection planning, establish a charitable foundation, and plan for possible disability using trusts and other vehicles. We aid business owners in succession planning using a variety of techniques and plans.

Estate litigation and dispute resolution

We represent executors, trustees, and beneficiaries in the litigation of disputes relating to estates and trusts. We have done so in controversies involving the interpretation of wills and trusts, issues of individuals’ mental capacity, and proof of undue influence. Our approach is to achieve our clients’ objectives in the most cost-effective and sensible manner, while understanding the sometimes overwhelming sensitivities involved in intra-family disputes.

Estate administration

Our trust and estate attorneys assist fiduciaries in administering estates and trusts. We advise executors and trustees on implementing wills and trusts, probate procedures, preparing tax returns, valuation of assets, and rendering estate and trust accountings.
