Environmental Litigation
Bressler’s environmental attorneys represent clients throughout the country in complex, multi-party environmental litigation involving contaminated properties and in smaller private actions involving cleanups for a wide variety of contamination, including underground storage tanks and discharges from manufacturing facilities. We are highly skilled in Federal (CERCLA/Superfund) and State cost recovery and contribution actions. We have experience negotiating disputes through mediation and alternative dispute resolution. Our attorneys have served as common counsel for multiple defendants at several CERCLA/Superfund sites throughout New Jersey and New York.
Regulatory Permitting and Compliance
We are deeply involved in regulatory issues facing today’s businesses. Drawing on the technical expertise and experience of several of our attorneys who have served as Deputy Attorneys General representing the New Jersey Department of Environmental Protection, we are uniquely situated to represent clients concerning Federal and State air, water, and solid and hazardous waste regulatory matters. Our attorneys counsel clients on complex permitting and compliance issues and have a particular expertise in ISRA. We also represent companies in administrative cases involving both Federal and State regulatory agencies. Our representation of clients includes oversight of environmental consultants and negotiation with environmental agencies concerning cleanup activities. We continually evaluate legislative and judicial developments in environmental law and their impact on clients’ operations.
Natural Resource Damages
Our attorneys continue to be at the forefront of regulatory initiatives involving the environment, including recent efforts by Federal and State governments to recover damages from private parties for injury to natural resources. We represent clients in agency actions involving natural resource damages, counsel clients concerning options for assessing and restoring injured resources and services, and are active in negotiations of natural resource damage claims with regulatory agencies.
Real Estate Transactions and Commercial Leases
Our environmental attorneys have extensive experience representing clients in the purchase, sale, and leasing of commercial properties. We have exceptional capabilities in counseling and negotiating for clients concerning the environmental risks of business transactions, including due diligence requirements, allocation of environmental responsibilities, and oversight of post-closing obligations. We counsel clients concerning the expansion, redevelopment, and reuse of contaminated properties (Brownfields) and the most recent agency initiatives concerning these projects.
Land Use
We represent clients in a wide variety of land use matters before municipal planning and zoning boards, including site plan and subdivision applications and use permitting issues.
