Insurance Law
Bressler, Amery & Ross is proud to offer a nationally recognized insurance practice that serves a well-known client base of major insurers and their holding companies, as well as financial service organizations, which include, among others, Aegon Companies, Alliance of American Insurers, American International Group, Centene Corporation, Citicorp, CNA Insurance Companies, Great American Insurance Companies, Kemper Group, Lancer Insurance Group, The Mercer Insurance Group, Merrill Lynch Insurance Group, MetLife, New York Life Insurance Company, J.P. Morgan Chase, Northwestern Mutual, Prudential, Shand Morahan Group, New Jersey Title Insurance Company, The Church Pension Fund, and Transamerica Group. The firm has long served as general counsel to the New Jersey Property-Liability Insurance Guaranty Association, the New Jersey Surplus Lines Insurance Guaranty Fund, and the New Jersey Life and Health Insurance Guaranty Association, and it has periodically provided counsel to other quasi-state and governmental entities. The insurance practice group is one of only a few in the region that is dedicated primarily to matters affecting the corporate regulatory, and enforcement aspects of insurance law. The scope of the firm’s insurance practice is comprehensive, involving a broad range of client engagements relating to both property-casualty and life-health and disability insurance, managed care law and reinsurance matters before various state and federal regulatory agencies and self-regulatory bodies as well as before administrative law judges and in the state and federal courts. The attorneys in the insurance practice group work closely with attorneys in the firm’s taxation, employment law and benefits, securities and workers’ compensation practice groups on issues relating to employee benefits and executive compensation, registered representatives/financial advisers, registered products, and ERISA welfare benefit plans, (including insurance funding mechanisms for health and pension plans and plan designs), agent disputes and workers’ compensation benefits and related issues.
Practice group members increasingly get involved in nontraditional insurance issues emerging from the broad platform of financial service providers. We advise clients on a variety of corporate, marketing, product development, and regulatory compliance matters, as well as in regulatory enforcement, litigation, arbitration, and appraisal proceedings, which include insurance law issues such as:
- Mergers and acquisitions
- Insolvency proceedings of regulated corporations
- Corporate and regulatory policies, administrative proceedings, litigation and appeals
- Company formation, admissions, licensing approval, and dissolution
- The interplay between, and compliance with, state and federal law when insurance wholly or partially funds ERISA benefit plans
- Market realignments and business restructuring
- Phase-down cessation of operations caused by market withdrawal, financial distress, or insolvency-related proceedings
- Product review and design
- Regulation of captive insurers
- The creation and regulation of self-insurance mechanisms as an alternative to traditional insurance
