Bressler Principal Cynthia Borrelli was quoted by Modern Healthcare in a conversation about U.S. healthcare reform and the class-action lawsuit filed by the Health Republic Insurance Company of Oregon against the government and the Affordable Care Act’s risk corridor program.

According to Cynthia, chair of Bressler’s Insurance practice, the spending bills passed by Congress that prevented the co-ops from receiving their full risk corridor payments “cut the companies off at the knees” but she believes “it was a lawful use of their appropriation authority,” and if the insurer wins, it could make it more difficult for Congress to amend the ACA in the future.

“I think it’s just another blow to the statute and another blow to the confidence the American people have in the government in terms of its ability to reform healthcare in the United States,” Cynthia said.
