Pursuant to DOBI Bulletin No. 15-06, the New Jersey Department of Banking and Insurance (Department) alerted the marketplace to pending revised regulations to clarify that new federal fees and taxes imposed pursuant to the Patient Protection and Affordable Care Act should be excluded from calculation of premium for purposes of determining the expense limits set forth at N.J.A.C. 11:10-1.9. The expense limits are critical to calculation of the loss ratio requirement specified at N.J.S.A. 17:48D-14 and N.J.A.C. 11:10 with respect to dental plan organizations. Exclusion of the federal fees and taxes from these calculations is intended by Commissioner Badolato to maintain the status quo in expense limitations.
